Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Kinolit website and its contents (the “Site”), operated by Kinolit Inc., a Delaware corporation (“Kinolit,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. What Kinolit is

Kinolit creates illustrated, scored, and annotated editions of public domain literary works (“Editions”). The Site lets you browse our Editions and, if you choose, join our mailing list. The Site is offered as-is and is still under active development; features may change, appear, or disappear without notice.

2. The works themselves

The underlying literary texts featured on the Site are in the public domain and belong to no one. Our additions to them, however, do not.

The illustrations, animations, audio and musical scoring, annotations, abridgments, edited and modernized text, design, code, and the overall presentation and arrangement of each Edition (collectively, the “Kinolit Materials”) are original works created by Kinolit and are protected by copyright and other intellectual property laws. The Kinolit name and logo are our trademarks.

3. What you may do

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and view the Site and the Kinolit Materials for your own personal, non-commercial enjoyment.

4. What you may not do

You may not, without our prior written permission:

copy, reproduce, download, scrape, harvest, or store the Kinolit Materials, in whole or in part, except for the ordinary technical caching your browser performs to display a page;
republish, distribute, sell, license, or otherwise make the Kinolit Materials available to others;
create derivative works from the Kinolit Materials;
use any automated system (bots, scrapers, crawlers) to access the Site, except for legitimate search-engine indexing;
use the Kinolit Materials to train, fine-tune, or develop any machine learning or artificial intelligence model or dataset;
remove or obscure any copyright, trademark, or other proprietary notices; or
use the Site in any way that is unlawful, infringes our or others' rights, or interferes with the Site's operation or security.

The public domain texts are free for you to use as you wish; these restrictions apply only to the Kinolit Materials.

5. The mailing list

If you provide your email address, you are asking us to send you occasional updates about Kinolit. You can unsubscribe at any time using the link in any email we send, or by writing to info@kinolit.com. How we handle your email is described in our Privacy Policy. You must be at least 16 years old to join the mailing list.

6. Changes to the Site and these Terms

We may change, suspend, or discontinue any part of the Site at any time. We may also update these Terms from time to time; when we do, we will post the revised Terms here and update the effective date above. Your continued use of the Site after changes take effect means you accept the revised Terms.

7. Disclaimers

The Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any defects will be corrected.

Nothing in these Terms excludes or limits any rights or warranties that cannot lawfully be excluded or limited, including certain rights you may have as a consumer under the laws of your country of residence.

8. Limitation of liability

To the fullest extent permitted by law, Kinolit and its founders, officers, and contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or in connection with your use of (or inability to use) the Site. To the fullest extent permitted by law, our total liability for any claim relating to the Site will not exceed one hundred US dollars (USD 100).

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. This section does not limit any liability that cannot lawfully be limited.

9. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware will have jurisdiction over any dispute arising from these Terms, and you consent to that jurisdiction.

If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction whose law grants you mandatory protections, nothing in this section deprives you of those protections, and you may also be entitled to bring proceedings in the courts of your country of residence.
